High Court Adjourns Sim Fubara’s Case Against Rivers Assembly, Speaker, Others

A High Court sitting at Isiokpo in Ikwerre Local Government Area of Rivers State has adjourned to Wednesday, December 20, 2023 to hear a suit brought by the State Governor, Siminalayi Fubara against his impeachment.

Fubara is seeking an order of the court restraining the State House of Assembly, the Speaker, Deputy Speaker, the Clerk and the State Chief Judge from impeaching him.

The presiding judge, Justice Opufaa Ben-Whyte adjourned the case over conflicting representation for the defendants.

Two sets of lawyers had appeared in court in defense of the Martin Amaewhule and Ehie Edison led factions of the House of Assembly when the matter came up for hearing.

The lawyers also told the court that they are appearing for two different sets of clerks who are also defendants.

One of the lawyers from the Edison Ehie’s camp, who spoke on condition of anonymity, told Kristina Reports that the judge advised them to sort themselves out and return to court after determining who is representing which of the defendants.

Recall that Fubara had approached the Rivers State High Court to stop the State House of Assembly from impeaching him and the court granted an interim injunction restraining the State Assembly from any impeachment efforts pending the hearing and determination of the suit.

Close watchers of the unfolding development believe the conflicting legal representation in the suit instituted by the Governor may not be unconnected to the speakership tussle in the Rivers State House of Assembly following the purported impeachment of Amaewhule on Monday, October 30, 2023.
